• L’offerta non implica la disponibilità delle apparecchiature, la quale potrà essere verificata solo in fase d’ordine.
• I materiali forniti a noleggio sono privi di assicurazione per il furto e/o smarrimento e sono sotto la responsabilità del cliente.
• Il locatario dovrà rispondere completamente dei danni causati al materiale a noleggio dovuti a negligenza e/o inosservanza delle istruzioni di utilizzo.
• Per ogni giorno di noleggio non autorizzato e, in ogni caso, non oltre il decimo giorno successivo alla scadenza pattuita, il Conduttore, ex art. 1382 C.C., è tenuto a corrispondere alla Service2Service s.r.l., a titolo di penale e salvi ulteriori danni, una somma pari al 3% del valore di mercato dei beni noleggiati.
• Allorché questi ultimi, nonostante sia trascorso il decimo giorno di cui sopra, siano ancora illegittimamente detenuti dal Conduttore, questi sarà perseguito anche in sede penale, con particolare riferimento all’appropriazione indebita.
• Qualsiasi cambiamento di programma o sospensione della fornitura, non imputabile al nostro operato, non potrà essere considerato motivo di modifica dei costi specificati nel preventivo.

In caso di annullamento dell’approvata fornitura:

• a) nelle 72 ore prima di quanto previsto e approvato, verrà addebitata una penale pari al 20% dell’importo concordato;
• a) nelle 48 ore prima di quanto previsto e approvato, verrà addebitata una penale pari al 30% dell’importo concordato;
• b) nelle 24 ore prima di quanto previsto e approvato, verrà addebitata una penale pari al 50% dell’importo concordato;
• c) in caso di avviata fornitura, partenza materiale (e/o personale) con corriere esterno o nostri mezzi, verrà addebitato l’intero importo concordato.

• Per preavvisi superiori ai 3 giorni / 72h prima di quanto previsto e approvato, salvo diversi accordi particolari, verrà addebitata una penale minima pari al 10% dell’importo concordato come addebito spese di gestione organizzativa, amministrativa e impegno materiale.
• Le tempistiche sono da considerarsi rispetto al giorno previsto di partenza materiale / inizio fornitura.
• In caso di malfunzionamento delle attrezzature da attribuirsi al Locatore, la responsabilità dello stesso non può comunque eccedere il prezzo pattuito con il Cliente in fase d’ordine; nel caso in cui i beni noleggiati abbiano perduto l’idoneità all’uso cui erano destinati, il Conduttore dovrà pagare integralmente il prezzo corrente di mercato degli stessi al locatore, salvo gli ulteriori e maggiori danni al medesimo arrecati.
• Con il ritiro delle apparecchiature noleggiate, il Cliente dichiara di essere in grado autonomamente, disponendo dell’adeguata capacità tecnica, di provvedere al loro corretto funzionamento.
• Service2Service non è dunque responsabile per inconvenienti, malfunzionamenti, danni che nascessero dall’uso non corretto delle stesse o da carenze nella capacità di utilizzo.
• Qualsiasi raggio laser che venga indirizzato verso le lenti dei videoproiettori DLP danneggia immediatamente in modo irreparabile il proiettore (acceso o spento che sia).
• Per qualsiasi controversia o contestazione, si conviene quale foro esclusivamente competente quello di Pesaro.

Con la conferma del preventivo si accettano esplicitamente tutte le clausole e condizioni sopra elencate.

• The offer does not imply the availability of the equipment, which can only be verified at the time of the order.
• The materials provided for rental are not insured against theft and/or loss and are under the responsibility of the customer.
• The renter shall be fully responsible for any damages caused to the rented material due to negligence and/or failure to follow usage instructions.
• For each unauthorized rental day, and in any case no later than the tenth day following the agreed deadline, the Renter, pursuant to art. 1382 of the Italian Civil Code, is required to pay Service2Service S.r.l., as a penalty and without prejudice to further damages, an amount equal to 3% of the market value of the rented goods.
• If the rented goods are still unlawfully retained by the Renter beyond the tenth day mentioned above, the Renter will also be prosecuted criminally, particularly with regard to misappropriation.
• Any changes in the schedule or suspension of the supply not attributable to our actions cannot be considered grounds for modifying the costs specified in the estimate.

In case of cancellation of the approved supply:

• a) within 72 hours before the scheduled and approved date, a penalty equal to 20% of the agreed amount will be charged;
• b) within 48 hours before the scheduled and approved date, a penalty equal to 30% of the agreed amount will be charged;
• c) within 24 hours before the scheduled and approved date, a penalty equal to 50% of the agreed amount will be charged;
• d) if the supply has already started, i.e., the materials (and/or personnel) have been dispatched by external courier or by our own means, the full agreed amount will be charged.

• For notices received more than 3 days/72 hours before the agreed-upon date, unless otherwise agreed, a minimum penalty of 10% of the agreed-upon amount will be charged to cover organizational, administrative, and material costs.
• The timing is to be considered in relation to the scheduled date of material dispatch/start of supply.
• In case of equipment malfunction attributable to the Lessor, the Lessor’s liability shall not exceed the price agreed with the Client at the time of order; if the rented goods have lost their suitability for their intended use, the Renter must fully pay the current market price of the goods to the Lessor, without prejudice to further and greater damages caused to the Lessor.
• By collecting the rented equipment, the Client declares to be capable, with the adequate technical skills, of ensuring its correct operation.
• Therefore, Service2Service is not responsible for any inconveniences, malfunctions, or damages arising from incorrect use of the equipment or lack of operational capability.
• Any laser beam that is directed towards the lenses of DLP video projectors immediately irreparably damages the projector (whether on or off).
• For any disputes or claims, the exclusively competent court is agreed to be that of Pesaro.

By confirming the quote, you explicitly accept all the clauses and conditions listed above.
